我国页岩气绿色开发的监管体系建设探讨

为保障能源安全供应和应对全球变暖的严峻挑战,伴随着钻井和水力压裂等关键技术的突破,近年来页岩气已成为国际能源领域关注的热点。不过,与常规天然气相比,页岩气开发面临较大的环境风险和气候风险,能否有效监管将影响其绿色开发进程。就中国而言,因受制于应对气候变化、优化能源结构以及提高大气环境质量等多重宏观约束,决策者对开发页岩气也给予厚望,但是我国现行条块分割的资源环境监管体制、适用性不足的环保法律体系、薄弱的环境监管能力以及对页岩气开发过程环境和气候风险认识不足,陡然增加了页岩气实现绿色低碳开发的变数。基于此,本文从阐述国内页岩气开发现状出发,探讨了我国页岩气开发环境监管存在的主要问题和障碍,总结了国外页岩气开发气候风险和环境风险综合防控的经验,最后基于环境风险和气候风险综合防范的现实需求,提出促进我国页岩气绿色开发监管体系建设的对策建议。

Abstract

In the dual constraint of energy safety and climate change,shale gas has become one of hotspots in the international energy field in the past several years,along with the technology breakthrough of horizontal drilling and hydraulic fracturing. However,shale gas exploitation has to face greater environment and climate risk,compared with conventional natural gas. The green development of shale gas depends on whether environmental risk of resource extraction is effectively regulated. In China today,we have to face multiple challenges such as climate change,energy structure optimization,and improvement of air quality. That is why policy makers place high hopes on shale gas development. But various real constraints such as current fragmented resource-environment regulatory system,poor applicability of existing environmental legal system,weak environmental monitoring capacity and inadequate understanding towards environment & climate risk,will lead to great uncertainty on green exploitation of shale gas. Based on this,the paper describes the state quo of shale gas development in China,explores main issues and major obstacles in current environmental regulation towards shale gas development,summarizes American environmental risk prevention experience in shale gas extraction,and finally puts forward relevant suggestions to facilitate the building-up of an environmental regulatory system towards green development of shale gas.
