2019年2月,中共中央、国务院印发了《粤港澳大湾区发展规划纲要》,为今后的大湾区建设指明了方向。由于大湾区的建设处于“一个国家、两种制度、三个法系”的状态,金融合作呈现出较为复杂的境况。在此背景之下,本文以粤港澳三地金融法制度的差异为切入点,深入分析制度差异产生的历史与法理缘由,并在此基础上,结合《粤港澳大湾区发展规划纲要》,提出在立法、司法以及执法三个维度下构建粤港澳大湾区金融法协调机制,从而打造粤港澳大湾区优良的法治化营商环境,加快高质量金融合作的步伐,进而达到粤港澳大湾区金融体制高度融合的目标。
In February 2019,the Central Committee of the Communist Party of China and the State Council issued the Outline of the Development Planning of Guangdong-Hong Kong-Macao Greater Bay Area,which points out the direction for the future construction of the Great Bay Area. As the construction of the Great Bay Area is in the state of “one country,two systems and three legal systems”,financial cooperation presents a more complex situation. Under this background,this paper takes the differences of financial law systems between Guangdong,Hong Kong and Macao as the breakthrough point,deeply analyses the historical and legal reasons for the differences. And on this basis,combining with the Outline of the Development Planning of Guangdong-Hong Kong-Macao Greater Bay Area,this paper proposes to build a coordination mechanism of financial law in Guangdong-Hong Kong-Macao Greater Bay Area from three dimensions:legislation,justice and law enforcement. In this way,we can create a good business environment under the rule of law in Guangdong-Hong Kong-Macao Greater Bay Area,accelerate the pace of high-quality financial cooperation,and achieve the goal of high integration of the financial system in Guangdong-Hong Kong-Macao Greater Bay Area.
