中国食品安全法的演变过程及发展趋势探析

中国食品安全法经历了一个漫长的发展阶段,而每个阶段的发展规划都是应时代要求而制定的。本文首先梳理了中国食品安全法的历史演变轨迹,划分为准备阶段、发展阶段和成熟阶段。其次,从三个方面分析了中国食品安全法的变迁原因:监管对象的变动是政策变迁的主要原因;不同利益主体间的动态博弈是政策变迁的根本原因;既定目标的实现是政策变迁的直接原因。最后,从建立风险评估与预警应急制度、加强监督制度和建立严格的法律责任制度方面揭示了中国新的《食品安全法》的发展趋势。

Abstract

The food safety law in China has gone through a long period of development,and each stage of the development plan meets the requirements of the times. This paper reviews the historical evolution of the food safety law in China,which is divided into preparation stage,development stage and mature stage. Then,the paper analyzes the change reasons of the food safety law in China from three aspects. Firstly,supervision object changes are the main reasons for the policy changes. Secondly,the dynamic game between different stakeholders is the fundamental reason of policy changes. Thirdly,realizing the goal is the direct cause of policy changes. Finally,the paper reveals the development trend of new “food safety law” in China through the establishment of risk assessment and early warning emergency system,strengthening the supervision system and the establishment of strict legal liability system.
