在当今的刑法学研究中使用经济分析方法，已经屡见不鲜。本文在考察刑法学的经济分析的内涵、地位，并阐明其基本主题、目标与理论预设的基础上，先后研究了经济分析方法在刑法哲学、刑法教义学、刑事政策学和刑事诉讼法学中的运用，最后提出了四项已经得到证实的结论和两项悬而未决的争议，以期抛砖引玉，唤起刑法学学术共同体对此问题的关注。
The economic analysis has become familiar in today’s criminal law research. This article，on the basis of the studies of the meaning and status of the economic analysis in criminal law and the explanations of its basic themes，aims and theoretical presumptions，successively studies the applications of the economic analysis in the fields of philosophy of criminal law，criminal law dogmatic，criminal policy science and criminal procedure law，and hopes that by doing these，it can arouse criminal law academic community to attach importance to this problem.
