2009年,欧盟法律发展主要包括三个方面的内容:一是关于《里斯本条约》的批准进程,特别是欧盟为解决2008年爱尔兰公投否决《里斯本条约》一事所作的努力;二是在二级立法方面,欧盟在自由、安全与公正及能源与环境保护等方面取得了一些新的进展;三是欧盟法院在判例法上的发展,主要涉及知识产权保护、欧洲议员的豁免权、欧盟立法行为的后果等方面。
This report comprehensively reviews the legal and judicial development of the European Union between September 2008 and September 2009,which consists of three parts. Part 1 relates the latest ratification process of the Lisbon Treaty,especially the EU’s efforts to solve the approval crisis caused by the “Irish No”. Part 2 gives a brief introduction to the development of the secondary legislation in the EU. In the past year,the EU made some progresses in secondary legislation especially in the area of freedom,security and justice and in the fields of energy and environmental protection. Part 3 analyzes the progress in the jurisprudence of the European Union’s courts,which mainly involves intellectual property protection,Parliamentary immunity and the consequence of the EU’s secondary legislation.
