宪法化无疑是芬兰刑法最显著的变化之一。传统意义上,刑法和宪法在法律科学和实践领域是完全独立的。但是,有一些特征和发展不可避免地使它们彼此变得更加紧密,甚至以不尊重这些法律领域传统分界的方式将它们互相联结。刑法的宪法化并不是芬兰所特有的现象,在一个更大的层面上与刑法的欧洲化有关。本文旨在探究在20世纪90年代中期,芬兰宪法中的基本权利条款改革以后所发生的芬兰刑法的宪法化。因此,本文的目的首先是对法治的一般意义作出一个简要概述,而后探究刑法中法治的含义与范畴,对法治的一般意义作出一个简要概述。其次,检验芬兰刑法宪法化的大致发展趋势。最后,探讨刑法法治中或许是最重要、最普遍的罪刑法定原则。
Constitutionalization is without doubt one of the most significant changes in Finnish criminal law. Traditionally criminal law and constitutional law have been separated in legal science and in practice. There are,however,certain features and developments that inevitably move them closer to each other and even connect them in a manner that does not respect the traditional boundaries of these legal domains. The constitutionalization of criminal law is not uniquely a Finnish phenomenon but has also a wider scope that is related,inter alia,to the Europeanization of criminal law. The purpose of this article is to explore the constitutionalization of Finnish criminal law that has mainly taken place after the reform of the fundamental rights provisions of the Finnish Constitution in the mid-1990s. The purpose of the article is,thus,to explore the meaning and the scope of the rule of law within criminal law with first providing a brief overview on the general meaning of the rule of law. Secondly,the general trend or development of constitutionalization of Finnish criminal law is examined. Thirdly,perhaps the most significant and universal manifestation of rule of law within criminal law,principle of legality,is discussed.
