建立立法监督与制约相分离的合法性审查机制

本文从宪法学的基本原理出发,主张一切依据宪法和法律享有公共权力的机构所制定的针对不特定社会公众生效的规范性文件都具有法律效力,可以约束一定行政区域范围内的所有社会公众的行为,但是,一切享有规范性文件制定权的公共权力机构必须依据宪法和法律的规定制定规范性文件,必须以合宪性和合法性作为规范性文件制定的法律依据。从法理上来看,保障规范性文件具有合宪性和合法性主要有立法监督和立法制约两个途径。立法监督是基于宪法和法律所赋予的立法职权进行的,其目的是保障宪法和法律所赋予的立法职权能够得到有效的行使。立法制约是根据宪法和法律赋予的权限,对其他公共权力机构依法制定的规范性文件是否符合宪法和法律进行合宪性审查和合法性审查,从而确保规范性文件的合宪性和合法性,维护法制的统一性。

Abstract

Based on the basic theory of constitutional law,this article holds that any normative document adopted by any organ holding public power in accordance with the Constitution or laws and applicable to un-specific members of the general public should have legal effect and be able to regulate the behavior of all members of the general public within the scope of specific administrative areas. However,all public authorities enjoying the power of adopting normative documents must exercise such power in accordance with the Constitution and laws and on the bases of constitutionality and legality. From the jurisprudential point of view,there are mainly two methods of ensuring the constitutionality and legality of normative documents:legislative supervision and legislative control. The former is exercised on the basis legislative functions and powers provided by the Constitution and laws for the purpose of ensuring the effective exercise such functions and powers whereas the latter is the review,on the basis of the competence provided for in the Constitution and laws,by public authorities of the constitutionality and legality of the normative documents adopted by other public authorities,for the purpose of ensuring the unity of the legal system.
