本文主要批判和反思了西方主流国际法学说将国际法禁止之干涉限于强迫性干涉的观点。通过分析国际法上非强迫性干涉的国家实践和学者学说,并结合对有关国际法文本的解读,本文提出了国际法一般性的禁止非强迫性干涉的法律公式:对有着根本重要性的主权事务,例如国家人格等主权要素,进行任何形式的干预均属国际法禁止的干涉行为。在此基础上,本文进一步阐明了国际法禁止强迫性干涉和非强迫性干涉在结构上的内在统一性。中国近年来提出的有关核心利益的国际法主张和外交实践,可以认为属于对国际法禁止非强迫性干涉的国家实践。
The article makes a critical reflection on the idea of confining the prohibited intervention under international law to coercive interventions as adopted by the mainstream international legal scholarships. After an analytical exploration of the existing scholarships and state practice on non-coercive intervention,the author proposes a general formula of prohibited non-coercive intervention:Any kinds of interference or threat against fundamental interests of sovereign states,by means of coercion or not,constitutes prohibited intervention under international law. The article further illustrates the structural coherence of constituent elements of coercive and non-coercive interventions. The recent China’s international law claim and diplomatic practice on core interest are relevant state practices on the international law prohibition of non-coercive intervention.
