从联合国人权委员会到人权理事会，联合国在人权领域的行动能力不断提升。与此同时，联合国人权条约逐步从纸面上的规范转变为约束国家实践的规范。这一进程中，国家主权一再受限。中国主张联合国人权保护机制应通过促进会员国间的平等对话以逐步提升国家保障人权的能力。这一立场符合国际法的基本原则及联合国处理人权问题的宗旨，当为协调国家主权与人权国际保护间关系的可取之道。
UN’s capacity to act in the field of human rights is upgrading from Commission on Human Rights to Human Rights Council.At the same time，norms of UN human rights treaties go from paper to States’ practice.With the evolvement of UN human rights protection movement，sovereignty of States has been narrowed time by time.China insists that UN human rights protection mechanism should provide a platform for Member States for equal dialogue，and should promote the capacity building of States on human rights protection.This position is in line with the fundamental principle of international law and with the aim of UN human rights protection cause.And it could be a proper alternative for harmonize the relationship between Sovereignty and International Protection of Human rights.
