世界范围内,移民妇女人数占据着跨国流动人口总数的半壁江山。然而在跨国流动过程中遭受国籍与性别的双重歧视是移民妇女从事就业活动的最大障碍,亦是导致她们成为最弱势群体的直接原因之一。保护移民妇女的劳动权利是改善移民妇女社会和经济地位的最佳途径。对此,欧盟以禁止双重歧视原则即禁止性别歧视和国籍歧视为切入点,为移民妇女进入移民目的国劳动力市场推开了一扇大门;通过构建两类平等的实质性举措,即移民劳动权利和妇女劳动权利的平等,作为提升移民妇女劳动力市场地位的台阶;同时,连续、协调的社会保障机制,为包括移民妇女在内劳动力的“跨国流动性”提供了坚实后盾和制度保障。
Though accounting for about half of the total number of people conducting cross-border movements worldwide,female immigrants may still be one of the most vulnerable groups experiencing the double discrimination in relation to nationality and gender,which would impede the employment of female immigrants in labor market of foreign countries.Therefore,the protection of labor rights of female immigrants should be considered as the best way to improve their social and economic situations.As far as EU protection mechanism is concerned,the principle of non-discrimination of nationality and gender provides female immigrants with the door accessing the labor market of EU member countries.Further,the dual equality of the labor rights with regard to immigrants and women would secure female immigrants’ status in labor market.Nevertheless,the EU social security system with continuousness and co-ordination may boost the mobility of the cross-border population as a whole.
