劳务争端解决机制是国际组织保障人权的重要制度安排。行政法庭是国际组织解决这类争端的主要场所。国际组织在解决劳务争端方面出现了新的实践趋势,理论上也有了新的动向。主要表现在以下三个方面:行政法庭将管辖权扩大至非正式职员、国际或国内法院对行政法庭所做裁决进行审查、国内法院在一定条件下对劳务争端案件行使管辖权。基于国际组织劳务争端解决机制在实践和理论上的新发展,对上述问题进行梳理和阐述,有利于这种机制的进一步完善。
Employment disputes settlement regime is the important institutional arrangement for international organizations (IOs) to protect human rights. Administrative tribunals are the main arena to settle these disputes. In the practice concerned,IOs need try to handle the three questions well below. They are (i) the expansion of jurisdiction of administrative tribunals to non-formal employees,(ii) the review by international or domestic courts of the decisions by administrative tribunals and (iii) the jurisdiction of domestic courts over employment disputes in given conditions. Discussion of those questions on the basis of new development of IOs employment disputes settlement in theory and practice is necessary for improving this regime.
