With the rapid development of artificial intelligence，it has significant social and economic prospects and strategic position，and its use will also bring subversive crisis to the society. Although China，at present，occupies a leading position in the field of artificial intelligence market and technology，there are obvious shortcomings in the construction of laws and mechanisms. Artificial intelligence must have the consciousness of humanoid autonomy，which should be regulated by criminal law，endowed with the ability of criminal responsibility and classified. In order to prevent and control the risk of artificial intelligence，we should formulate relevant laws and policies，improve the regulatory mechanism，standardize the application of science and technology，and establish an ethical action program.
