俄乌冲突持续升级、气候变化和BBNJ协定通过等因素正在改变北极渔业治理格局。一方面,在地区安全态势日趋严峻的背景下,北极渔业成为国际合作的宝贵平台;另一方面,渔业资源分布变化和国际立法新发展在一定程度上冲击了当前北极渔业治理格局的稳定性,推动了北冰洋沿海国法律政策的新变化。北极渔业议题是我国参与北极事务的重要平台,我国应从国际政治和国际法的角度,持续关注北极地区局势、相关国际法律框架和北冰洋沿海国政策实践的新发展,以有的放矢地与各国进行渔业对话,并将合作拓展至航运、科学研究、环境保护等领域。同时积极地进行国际法应对,把握相关国际法理论和规则解释发展的主导权。
Factors such as the escalating Ukraine crisis,climate change and the adoption of the BBNJ Agreement are changing the international seascape of Arctic fishery governance. On the one hand,Arctic fishery has become a valuable platform for international cooperation under the increasingly serious regional conflict and related security situations;on the other hand,changes in the distribution of fishery resources and new developments in international legislation have,to some extent,undermined the stability of current Arctic fishery governance and promoted new changes in the laws and policies of Arctic coastal states. Arctic fishery provides an important platform for China to participate in Arctic affairs. From the perspectives of international politics and law,China should continue to remain well-informed of the situation in the Arctic region,the relevant international legal framework and new developments in the policies and practices of Arctic coastal states. China should conduct dialogue in Arctic fishery with other countries,and expand cooperation to shipping,scientific research,environmental protection and other fields. We should be alert to the potential risks posed by the United States and others with regard to how they deal with Arctic issues and those relating to the South China Sea as a whole in terms of denying China’s maritime rights and interests. We should respond with the tool of international law and assume a lead role in the development of relevant international law principles and rules.
