非洲国家自独立后,在宪法法律制度探索上已走过60余年历程。在此期间,非洲国家宪法法律制度经历了模仿、变革、转型和重塑四个阶段,每一阶段均有相应的制度变化。这一过程是漫长的,甚至是动荡的,非洲各国在这一过程中基本实现了公民宪法权利的构建、公权力的构建与分配、行政权的适度限制。非洲国家的宪法、民主取得了长足进步,但仍存在一些较为突出的问题。究其原因,经济发展的决定性作用、国内政治力量的变化、社会团体力量的发展、外在因素干扰过多等方面影响深远。非洲国家仍将继续坚定地走民主道路,公众参与制宪进程模式的探索、多样性的宪法管理、针对宪法法院和分支机构的改革、政府治理和选举制度的完善将是今后的改革重点。
Since independence,African countries have gone through more than 60 years in the exploration of constitutional and legal systems. During this period,the constitutional and legal systems of African countries have experienced four periods including imitation,reform,transformation,and reshaping,each with corresponding institutional changes. In this process,African countries have basically realized the construction of citizens’ constitutional rights,the construction and distribution of power,and the appropriate restriction of administrative power. African countries have made great progress in constitutional democracy,but there are still some prominent problems. The causes for these problems include the decisive role of economic development,changes in domestic political forces,the development of social group forces,and excessive external interference,etc. African countries will continue to firmly follow the path of democracy,so the exploration of the model of public participation in the constitutional process,diversified constitutional management,the reform of the constitutional court and branches,and the improvement of the government system and electoral system will be the focus of reform in the future.
