随着我国游戏产业发展,游戏换皮现象频频出现,对游戏创作者的创新动力和游戏市场公平竞争环境造成了不容小觑的消极影响。既有案例表明,在司法实践中我国法院大多倾向于以《著作权法》对游戏换皮予以规制。然而,受到思想与表达二分法自身的限制,《著作权法》保护模式难以实现保护属于思想范畴的游戏规则等核心要素的目的,而混同原则和必要场景原则也进一步加大了以《著作权法》规制游戏换皮的阻力。不妨另辟蹊径,在参考借鉴韩、日、德等国立法或司法经验的基础上,考虑尝试在《反不正当竞争法》中明确创设禁止“不当模仿竞争者产品”的具体条款,作为规制游戏换皮的一种新思路,以达到激活、保护游戏产业创新与维护公平竞争市场环境的双重目标。
With the development of China’s game industry,game clones are frequently seen,which causes a negative impact on the incentive of game creators and the fair competition environment of the game market. In existing cases,Chinese courts tend to use intellectual property law. However,limited by the idea/expression dichotomy,it is difficult for intellectual property law to protect the core elements of game rules in the idea domain,and the doctrine of merger and scenes-a-faire also make it harder to use intellectual property law to regulate game clones. Based on a reference and comparison of the judicial or legislative situation in Korea,Japan,Germany and other countries,a different approach could be considered:regulating by anti-unfair competition law,by establishing specific provisions prohibiting imitation of competitors’ products,applying them to regulate game clones,and creating a good market competition environment for the game industry.
