AIGC的快速发展，对于监管提出了新的挑战，以往的备案审核形式无法适应新兴技术发展要求，AIGC技术的不透明性、训练语料的庞大且杂乱、AI自动学习过程中的监督等都对AIGC的监管提出了新的挑战。对于AIGC的监管既不能“一刀切”，也不能完全放任置之不理，如何通过有效、自动化的监管来促进AIGC行业整体的健康发展是本文关注的重点之一。在AIGC的快速发展和我国提出对生成式人工智能的监管背景下，本文从对AIGC进行监管的必要性、AIGC监管的概念和内涵入手，研究探讨我国AIGC监管现状和困难，通过构建一套AIGC监管框架以及对比国内外相关经验和政策趋势，提出完善我国AIGC监管的对策建议。
The rapid development of AIGC has posed new challenges to regulation. Previously，the form of filing and auditing was unable to adapt to the development requirements of emerging technologies. The opacity of AIGC technology，the large and chaotic training corpus，and the supervision during AI automatic learning have all posed new challenges to AIGC regulation. The regulation of AIGC cannot be simple and crude，nor can it be completely ignored. How to promote the overall healthy development of the AIGC industry through effective and automated regulation is one of the focuses of this article. This article takes the rapid development of AIGC and China’s proposal to regulate generative artificial intelligence as the research background. Starting from the necessity of regulating AIGC and the concept and connotation of AIGC regulation，it explores the current situation and difficulties of AIGC regulation in China. By constructing a set of ideas and frameworks for AIGC regulation and comparing relevant experience and policy trends at home and abroad，it finally proposes countermeasures and suggestions for AIGC regulation in China and future prospects.
