2022年3月4日,菲律宾总统签署通过菲律宾共和国第11647号法案,该法案是对1991年《外国投资法》进行的最大幅度修订,它允许符合条件的非菲律宾国民在菲部分行业经营投资并全额控股,允许外籍专业人员和专家获得工作签证在不受特别法律限制的行业就职。此外,菲律宾《公共服务法》及《零售贸易自由化法》中的涉外经营条款也先后进行重大修订。在RCEP正式生效实施及区域工业4.0发展浪潮的背景下,减少外商投资法律壁垒将有助于菲律宾刺激受疫情影响的疲软经济,以获得更具国际竞争力的外资营商环境。然而,菲律宾外资营商环境的根本改善仍需要大量的软硬件配套设施建设以及更具支撑性的产业政策支持,赴菲投资仍然存在诸多政策及法律风险。
On March 4,2022,the President of the Philippines signed and passed Republic of the Philippines Act No.11647,the most significant amendment to the Foreign Investment Act of 1991,which allows eligible non-Philippine nationals to operate and invest in certain industries in the Philippines with full ownership,and allows foreign professionals and experts to obtain work visas to work in industries that are not restricted by special laws. In addition,significant amendments were made to the Public Service Act and the foreign-related business provisions of the Retail Trade Liberalization Act. Against the backdrop of the RCEP and the regional Industry 4.0 wave,the reduction of legal barriers to foreign investment will help the Philippines to stimulate its sluggish economy affected by the epidemic in order to achieve a more internationally competitive business environment for foreign investment. However,the fundamental improvement of the foreign investment business environment in the Philippines still requires a lot of hardware and software facilities as well as more supportive industrial policies,and there are still many policies and legal risks to invest in the Philippines.
