数据是粤港澳三地协作发展的关键要素，这也为数据安全规则发展带来了挑战。首先，本报告从“数据利用”和“数据保护”两个维度探讨数据安全的重要性。推动“数据利用”中的“跨境数据自由流动”有益于数据更好地应用于数字服务，做好“数据保护”则涉及个人、企业乃至国家层面的数据安全保障。其次，本报告分析了美式和欧式数据安全规则体系以及中国既有规制，为粤港澳大湾区数据安全规则发展提供借鉴。最后，本报告认为可从对接国际高标准数据流动规则、衔接与完善粤港澳三地签订的既有规则和推动内地相关法律的完善与升级这三个路径推动粤港澳数据安全规则发展。
Data is a key factor in the collaborative development of the Guangdong-Hong Kong-Macao Greater Bay Area，which also brings challenges to the development of data security rules. Firstly，this paper discusses the importance of data security from two dimensions of “data utilization” and “data protection”. Promoting the “free flow of cross-border data” in “data utilization” is conducive to making data better apply to digital services，while developing “data protection” contributes to ensuring data security at the level of individuals，enterprises and even countries. Secondly，it analyzes the American and European data security rules system and the existing regulations in China，so as to provide reference for the development of data security rules in the Guangdong-Hong Kong-Macao Greater Bay Area. Finally，this report believes that the development of data security rules in Guangdong，Hong Kong and Macao can be promoted through three ways：aligning with international high standard of data flow，improving the existing rules signed by Guangdong，Hong Kong and Macao，and promoting the construction and improvement of relevant domestic laws.
