本报告对比了国内外“双碳”法律研究现状，总结了发达国家碳达峰、碳中和在立法、执行等方面的经验，如明确碳中和目标的法律地位，落实碳中和目标的实施路径，健全碳中和目标的规划体系，制定碳中和目标的辅助政策等。在中国国情的基础上，提出适时制定应对气候变化的国家专门立法、增强相关立法之间的协调性、增强执法与司法保障能力等政策建议。
This report compares the research status of “double carbon” law at home and abroad，summarizes the experience of carbon peak，carbon neutrality legislation and implementation in developed countries，and puts forward policy suggestions such as timely formulating national special legislation to deal with climate change，enhancing the coordination between relevant legislation，and enhancing the ability of law enforcement and judicial guarantee based on China’s national conditions.
