Green technology priority examination is a type of patent priority examination system. Under the global climate crisis，many countries have established this system one after another，and Measures for the Administration of the Prioritized Examination of Patents also introduced this system. This system aims to promote the innovation of green technology and accelerate the application cycle，and ultimately contribute to the realization of “carbon neutrality” and “peak carbon dioxide emissions” in the world. However，it still faces difficulties in the institutional system and the practice of different rights and interests，and restricts the realization of this utility. In order to ensure the effective operation of the system，it is necessary to improve both the system and the practical level. At the institutional level，it is recommended to make clear provisions in the Patent Law to ensure the legal basis；at the practical level，from the perspective of different stakeholders，the system needs to ensure that technology and national interests come first，and at the same time，private stakeholders should be considered. From the perspective of international development，it is recommended to build a conventional examination mode and an examination system that combines PCT and MOTTAINAI modes.
