在网络直播和短视频领域,作为“互联网原住民”的未成年人人数不断攀升,已成为内容的重要发布者、提供者和使用者。未成年人的心智行为有着特殊的发展过程,且存在诸多潜在特性,其各项权益极易受到网络内容的侵害。本研究从未成年人作为传播主体的角度出发,探讨网络直播、短视频平台未成年人法律侵权问题,包括未成年人出镜直播、借“网红儿童”牟利和侵犯未成年人隐私和个人信息三大问题,并从法律法规、司法实践、检察监督与行政履职、行业自律与平台自治四个方面来分析我国未成年人网络保护的现状,探讨现行法律实施过程中面临的困境,并借鉴他国法律法规中可行的内容,为我国相关法律的完善提出切实可行的建设性意见。
The number of minors,known as “Internet natives”,is increasing,and minors have become important publishers or providers of content on live webcast and short video platforms. Based on the specific age stage,the psychology,intelligence and behavior of minors have special development process and many potential characteristics,so their Internet rights are vulnerable to infringement. From the perspective of minors as the main body of communication,this study discusses the legal interest infringement of minors on live webcast and short video platforms,including on-camera live broadcasting of minors,profiting from “Internet celebrity children” and infringement of minors’ privacy and personal information. From the four aspects of law and regulation,judicial practice,procuratorial supervision and administrative duty,industry self-discipline and platform autonomy,the study also analyzes the current situation of the network protection of minors in our country,and then discusses the plight of the current law in the process of implementation. By referring to the feasible contents of other countries’ laws and regulations,putting forward practical and effective constructive suggestions to improve Chinese laws.
