南部非洲是非洲较为稳定且具有资源优势和经济增长潜力的地区之一,南部非洲国家多通过采矿业创造国家财富,提高社会发展水平。目前,所有南部非洲国家都将环境评价和许可制度纳入了矿业管理规范,该制度成为矿产资源开采的前提条件。同时,南部非洲国家多借鉴南非相关制度,基本形成了类似的环境立法框架,而南部非洲发展共同体的环境协定也明确了环保规定。据此,各国环境保护执法机构设置合理、职能全面,环境许可要求和环境影响评价流程严格,其中赞比亚和南非的矿业法律制度较为完备。然而,南部非洲环境管理制度也存在不少缺陷,增加了投资过程中的环境法律风险。因此,企业应加强对当地环境法律制度的了解,关注重点投资行业的环境法律规制,积极在项目开始前进行环境评价,依法申请东道国要求的许可证书,完成项目结束后的环境修复,履行必要的企业社会责任,树立良好的投资形象。
Southern Africa is one of the more stable and resource-advantaged and economic growth potential regions in Africa,and southern African countries mostly create national wealth and improve social development through mining. At present,all southern African countries have incorporated the environmental assessment and permit system into the mining management norms,which has become a prerequisite for mineral resources exploitation. At the same time,most southern African countries have borrowed from the relevant system in South Africa and basically formed a similar environmental legislative framework,while the environmental agreement of the Southern African Development Community also specifies environmental protection provisions. Accordingly,the countries’ environmental protection enforcement agencies are reasonably set up and comprehensive in their functions,with strict environmental permit requirements and environmental impact assessment processes,among which Zambia and South Africa have more complete mining legal systems. However,the environmental management system in Southern Africa also has many defects,which increases the environmental legal risks in the process of investment. Therefore,enterprises should strengthen their understanding of the local environmental legal system,pay attention to the environmental legal regulation of key investment industries,actively conduct environmental assessment before the start of the project,apply for the permit certificate required by the host country according to the law,complete the environmental remediation after the project,fulfill the necessary corporate social responsibility,and establish a good investment image.
