数据跨境流动的加速对国际贸易秩序、用户信息保护、国家司法管辖产生显著影响。综观国际数据跨境流动的管理，各主要国家与地区多以数据有序自由流动为原则，以特殊数据分类监管为例外的方式，构建数据跨境流动监管机制。针对中国数据跨境流动监管机制而言，我国应适时制定针对数据跨境流动监管的高位阶法律，并积极打造并参与跨境流动监管的国际合作机制。
The acceleration of cross-border data flow has had a significant impact on the international trade order，the protection of user information，and national jurisdiction. A review of global practice of regulation of cross-border data flow shows that main countries and regions in the world have constructed the mechanism for the regulation of cross-border data flow by taking the orderly free flow of data as the rule，and classified regulation of special data as the exception. As for the Chinese mechanism for the regulation of cross-border data flow，the author suggests that the government should adopt high-level law in this field and actively participate in the creation and implementation of an international cooperative mechanism for the regulation of cross-border data flow.
