网络战争是网络安全治理的一个前沿问题,其核心法律争议在于网络战争是完全适用于现行国际法,还是需要创造新的国际立法。北约卓越合作网络防御中心邀请专家组编纂的《塔林手册》号称是完全适用现行国际法的“第一部网络战争规范法典”,而事实上,《塔林手册》在关键法律问题上的规则创制多于对现行国际法的适用。中国网络安全和网络战争的法律对策是:在国际法上争夺网络战争法律解释话语权,并在“总体国家安全观”指导下,实施《网络安全法》,推动网络安全的国际立法,避免网络空间的“军事化”。
The core legal controversy over cyber warfare,which is a frontier issue in the field of cybersecurity legal governance,lies in the question of whether the current international law is completely applicable to cyber warfare,or a new set of international law needs to be created to regulate this new type of warfare. The Tallinn Manual was written by an international group of experts at the invitation of the Tallinn-based NATO Cooperative Cyber Defence Centre of Excellence. Although it is known as “the first code of rules on cyber warfare” that restates the applicable existing international law,on many key legal issues it is in fact more the result of creation of new rules than a restatement of existing international law. In view of the current situation in the field of cybersecurity and cyber warfare,the author of this report suggests that China take the following legal countermeasures:to fight for the discourse power in the interpretation of international law applicable to cyber warfare,to implement the Cybersecurity Law under the guidance of “the overall national security outlook”,to promote international legislation on cybersecurity,and to avoid the “militarization” of cyberspace.
