在掌握互联网技术和海量数据的基础上，网络运营商不仅成为网络空间一支举足轻重的“私权力”，而且改变现实的社会权力结构。本文分析“私权力”崛起的表现，以及“私权力”崛起背景下网络安全机制的核心使命及应当注意的问题，并在对网络治理需要解决的三个主要矛盾进行分析的基础上，探讨当下网络安全机制和治理路径存在的问题，指出网络安全机制的建立应充分发掘知识（技术）作为治理资源的功能，同时协调好“公”“私”权力的关系，促进网络空间的安全、发展和自由。
Mastering internet technologies and massive data，network operators not only become a pivotal “private power” in cyberspace，but also change the structure of social power in reality. This paper analyzes how “private rights” come into being，what is the core mission of network security system in the context of “private rights” and the issues should be noted. Based on the analysis of the three major issues need to be resolved in cyber legislation，this paper discusses the problems of current internet regulatory approach，and points out that the cyber security system should fully explore the function of knowledge（technology）as regulatory resource，and coordinate the relationship between “public” and “private” powers，so as to promote the security，development and freedom of cyberspace.
