巴西的公开招标和采购制度目前受1993年6月21日第8666号法律（第8666/93号法律）规管。自2013年开始，巴西参议院着手制定了新招投标法案（第1292/95号法案）。2019年3月，众议院启动了紧急审议程序并于6月批准了草案大纲文本。该法律草案引入了招标制度的许多更新。本文总结该法案的新制度和变化，重点涉及招标流程、招标程序、合同、提出异议、请求澄清和复议，以及对公共采购的监控。
The public bidding and procurement system in Brazil is currently regulated by the Law No.8.666，of 21 June 1993 （Law No.8.666/93）. Since 2013，the Brazilian Senate has initiated the elaboration of the new Law on Bidding （Bill 1.295/95）. In March 2019，the Chamber of Deputies initiated the urgent deliberation procedures and approved the draft law in June. This Draft Law introduced many updates to the bidding system. This paper summarized the new rules and changes of the Law，with a particular focus on bidding process and procedures，contracts，raising objections，requesting for clarification and reconsideration，as well as monitoring public procurement.
