2020年中国与周边国家共建“一带一路”的法律风险挑战与防范

“一带一路”倡议的首要合作伙伴是周边国家,首要受益对象也是周边国家。自2017年提出构建中老和中缅经济走廊的倡议以来,我国不断通过法治方式巩固与周边国家的合作成果。近年来,虽然我国周边国家的政治法律环境总体稳定,但个别国家存在滥用国际国内法律工具的风险,特别是在百年未有之大变局的背景下,中资企业赴周边国家投资面临法律制度风险、执法行为风险、争议解决风险、企业合规风险和国际形势风险。为进一步推动与周边国家共建“一带一路”,我国需加强对“一带一路”倡议的顶层设计与国别设计。具体而言,应当充分运用多边、双边经贸协定的规制功能,不断推动中国法治成果为周边国家理解、认同与借鉴,积极提升企业的合规意识与法律运用能力,并切实提高我国涉外法律服务的能力水平。

Abstract

The primary partners of “Belt and Road Initiative” are peripheral countries,and the first beneficiary are also the neighboring countries. Since the initiative of building the China-Laos and China-Myanmar economic corridor was put forward in 2017,China has continuously consolidated the achievements of cooperation with neighboring countries through the rule of law. In recent years,although the political and legal environment of China’s neighboring countries is generally stable,some countries have the risk of abusing international and domestic legal tools. Especially in the context of the great changes that did not take place in the last century,Chinese enterprises are faced with domestic legal risk,law enforcement risk,dispute resolution risk,enterprise compliance risk and external environmental risk. It shall strengthen the national top-level design,as well as enhance the understanding of host country characteristics,to further promote “Belt and Road Initiative”. Specifically,we should make full use of the regulatory functions of multilateral and bilateral trade and investment agreements,constantly promote the understanding,recognition and reference of China’s legal achievements to neighboring countries,actively enhance the legal awareness of enterprises,and effectively improve the quality of China’s foreign-related legal services.
