环境信息公开条例发布三周年的回顾与展望

中国政府环境信息的主动公开水平有了总体提升,但区域和信息类别上不够平衡。企业环境信息公开工作则基本上处于起步阶段。民间环保组织推动和环境保护部门互动并组织培训,但申请信息不积极,部分组织采用柔性方式来推动企业信息公开的做法令人耳目一新。在几起典型案例中,几乎没有申请人能够顺利获得所需的环境信息,但最新的司法解释呈现若干亮点。未来发展可能呈现以下趋势:环保部门的信息公开工作将从重形式深入到重内容,民间环保组织将从以侧重单纯追求信息公开为主发展到以使用信息为主,企业强制信息公开应该有较大突破。

Abstract

The Chinese Government's active disclosure of environmental information has improved as a whole,but imbalances are found across regions and in terms of types of information. Companies are still at the starting stage in disclosing their environmental information. Non-governmental organizations have been promoting interaction with environmental protection agencies and organizing trainings,but the application for this service remains inactive. Some NGOs' flexible approaches to promote company environmental information disclosure are rather impressive. In several typical cases,applicants can hardly access the environmental information they need. However,encouraging signs have been found in the latest judicial interpretations. As for the prospect of environmental information disclosure,the following features might be identified: environmental protection agencies will shift their emphasis from the form to the substance of information disclosure; NGOs will not only continue seeking information disclosure but also advocate the use of information; there might be breakthrough in mandatory company environmental information disclosure.
