本文从“中国裁判文书网”和“北大法宝网”以及北京市部分法院收集了总共9起短视频著作权纠纷案，发现这些案件均于2018年审理结案，且涉及的侵权主体均是网络服务提供商，总体可以反映出我国目前短视频著作权纠纷的一些问题。因此，围绕这9起案件，本文从短视频著作权纠纷及其保护现状、诉讼特点、争议焦点和平台侵权等角度展开剖析。考虑到当下日益增多的短视频著作权争议纠纷，结合《著作权法》修订草案，本文最后从法律体系、技术措施和行业努力等三个角度对短视频著作权纠纷问题提出建设性意见。
From “China Judgment Online”，“PKU law” and some courts of Beijing，this article collects nine short video copyright cases. All cases were valid in 2018，and the infringement subjects were all internet service providers，which can generally reflect the short video copyright disputes in China. Therefore，focusing on these nine cases，this paper presents the current situation of short video copyright protection，litigation features and focus of disputes in the platform infringement. Considering the increasing number of short video copyright disputes currently and the revised draft of copyright law，the article finally puts forward constructive opinions on short video copyright disputes from the perspectives of legal system，technical measures and industry efforts.
