本文对2018年涉网络空间舆情的刑事案件展开了搜集和分析，通过这些案例，本文将舆情划分为作为治理线索的舆情，作为恶性情节的舆情，以及作为定罪依据的舆情三类，试图通过刑事案件全面呈现我国舆情治理现状。笔者发现，舆情治理已经成为政府主体开展治理的重要工具，在垂直板块和平行政府部门之间良好的联动下，针对已经发生的舆情相关案件能够协同行动，迅速出击，打击犯罪。但网络舆情是工具，背后也是一个个真实的个体，舆情在多数情况下是民众意见的汇集，因此，本文提出，在利用舆情的同时，更应当抱有社会治理中基础的社会关怀，以更好地实现善治。
This article collected and analyzed the criminal cases involving public opinion in cyberspace in 2018. By dividing these cases into three categories：governance by grievance，grievance as case plot and governing grievance，the author try to comprehensively present the grievances reflected in criminal cases and among which reflected governance status. This paper finds that public opinion has become an important tool for the government to carry out governance. Under the good linkage between the vertical sector and the parallel government departments，they can act in concert to quickly attack and crack down the public opinion-related crime. However，online public opinion maybe a good tool，but behind which there is also a real individual. Public opinion is a collection of people and their opinions in most cases. Therefore，this paper proposes that while using tools，the gouernor should also have the social care，thus to achieve good governance.
